Agreed - on all counts.  I work in media licensing.  I am also a content creator, through photography and video.  The supposed rights enshrined in ‘Fair Use’ threaten creative enterprise as much as it is a tactic abused by content creators.  Most of this kind of theft can simply be attributed to laziness and a general ignorance of proper media-use etiquette.  If someone else generated that content, attribution and compensation are important details to resolve.
